Graham and Marshal Arraigned in Federal Court on First Degree Murder Charges

Graham and Marshall Appear in Court

Rapid City, SD

United States Attorney Marty J. Jackley announced that John Graham aka John Boy Patton and Vine Richard Marshall aka Dick Marshall have been arraigned in federal court in Rapid City on the first degree murder charges contained within the superseding indictment. Defendants Graham and Marshall are charged with committing and aiding and abetting in the first degree murder of Annie Mae Aquash aka Annie Mae Pictou on or about December 12, 1975, on the Pine Ridge Indian Reservation in Indian Country. The superseding indictment alleges alternative counts based upon the Indian status of Defendant Graham and Annie Mae Aquash. Count one alleges jurisdiction over both Graham and Marshall based upon their Indian status. Count two alleges jurisdiction over Graham based upon Aquash’s Indian status. Count three alleges jurisdiction over Graham based upon Graham’s aiding and abetting certain individuals who are Indians, including Fritz Arlo Looking Cloud, Theda Nelson-Clarke, and Dick Marshall, in the murder of Aquash in Indian Country. All counts have a penalty of mandatory life imprisonment. The charges are merely accusations and Graham and Marshall are presumed innocent until and unless proven guilty. The investigation is being conducted by the FBI and BIA. United States Attorney Marty J. Jackley and Assistant US Attorney Robert A. Mandel are prosecuting the case. The Defendants remain detained and in the custody of the US Marshal. # # #
